1. TERMS AND CONDITIONS OF SALE 

These are the terms and conditions under which we deliver the goods to you. Why should you read them? Please read these terms carefully before submitting your order. It is in fact important for you to know who we are, how we will supply you with the products, how we can both modify or withdraw the contract, what to do in case of problems and other important information.

3. OUR AGREEMENT WITH YOU

When is an order accepted? The acceptance by us of your order will take place officially once we have taken charge and sent an email to take charge of the order, at which point a contract between the parties will come into force.

What if we can't accept your order? If we are unable to accept your order, we will notify you of this and will not charge you for the product. This could be because the product is out of stock, due to unexpected limits on our resources that we could not reasonably plan for, because we have identified an error in the price or description of the product, or because we are unable to meet a delivery deadline. specified.

Your order number. We will assign an order number to your order and tell you what it is via your order confirmation email.

4. OUR PRODUCTS

The products may vary slightly from their images. Product images on our website are for illustrative purposes only. While we have made every effort to display colors accurately, we cannot guarantee that the display of colors on a device accurately reflects the color of the products. Your product may vary slightly from those images. Although we have made every effort to be as accurate as possible, as our products are handmade, all dimensions, weights, capacities, dimensions and measurements shown on our website have a tolerance of 2%. Product packaging may vary. The product packaging may vary from that shown in the images on our site.

5. SUPPLY OF PRODUCTS

  • Delivery cost. The delivery costs will be those displayed on our website.

  • When will we deliver the products. We will deliver them to you as soon as reasonably possible and in any case within 30 days from the day we accept your order. If we accept your order, we will endeavor to ship a product the next business day. We expect the products to reach you within approximately 7 business days. We are not responsible for delays beyond our control.

  • If our supply of the products is delayed by an event beyond our control, we will contact you as soon as possible to inform you and we will take steps to minimize the effect of the delay. We will not be responsible for delays caused by other events, but if there is a risk of a substantial delay, you can contact us to terminate the contract and receive a refund for products you have paid for but not received.

  • If you do not collect the products from us as agreed or if, after a non-delivery, you do not rearrange the delivery or collect them from a delivery depot, we will contact you for further instructions and we may charge you for storage costs and any additional delivery costs. If, despite our reasonable efforts, we are unable to contact you or rearrange delivery or collection, we may terminate the contract and clause 2 will apply.

  • When you become responsible for the goods. The goods will be under your responsibility from the moment we deliver the product to the address you have provided to us.

  • When you own assets. Own a product once we have received full payment.

  • What happens if you do not provide us with the requested information. We may need certain information from you  so that we can provide you with the products.  If this  will not have been indicated on our website, we will contact you to ask for this information. If you do not provide us with this information within a reasonable time requested by us, or if you provide us with incomplete or incorrect information, we may terminate the contract (and clause 2 will apply) or charge an additional fee of a reasonable sum to compensate us for any extra work. required accordingly.

  • We will not be liable for the delayed supply of the products or for the failure to supply any part of them if this is caused by the fact that you have not provided us with the information we need within a reasonable time after we have requested it.

 

6. YOUR RIGHTS TO TERMINATE THE CONTRACT

You may be able to terminate your contract with us. Your rights when you terminate the contract will depend on what you have purchased, if there is something wrong, how we are behaving and when you decide to terminate the contract. If what you have purchased is defective or misdescribed, you may have a legal right to terminate the contract (or to have the product repaired or replaced, or to obtain a partial or full refund). If you want to terminate the contract because of something we have done or told you we will do, see clause 2. If you have just changed your mind about the product, see clause 3. If you are terminating a contract for any of the above reasons, the contract will terminate immediately and we will refund you in full for any products that have not been supplied. The reasons are:  we have reported an error in the price or description of the product you have ordered and you do not wish to proceed; there is a risk that the supply of products may be significantly delayed due to events beyond our control; you have the legal right to terminate the contract because of something we have done wrong.

Exercising the right to change your mind. For most products purchased online, you have the legal right to change your mind within 14 days and receive a refund. These rights, pursuant to the 2013 Consumer Contracts Regulation.

When do you have the right to change your mind? You have no right to change your mind about:

  • for products sealed for reasons of health protection or hygiene e  opened after receiving them;

  • all products that are inseparably mixed with other items after their delivery.

How much time do you have to change your mind? You have 14 days from the day you (or someone named by you) receives the good.

 

7. HOW TO TERMINATE THE CONTRACT WITH US

To terminate the contract with us, just send us an e-mail to luanaslicata@gmail.com. Please provide your name, home address, order details and, if available, your telephone number and email address.

Return of products after termination of the contract. If you terminate the contract for any reason after the products have been shipped or received, you must return them to us. You must send us an e-mail at the adressoluanaslicata @ gmail .com to arrange collection and send it back to Inkakì c / o Luana Licata Via Pompei 32, 92019 Sciacca - Ag - Italy.

If you are exercising your right to change your mind, you must ship the goods within 14 days of communicating that you wish to terminate the contract.

When will we pay the return costs. We will pay the return costs:

  • if the products are defective or misdescribed;

  • if you are terminating the contract because we have informed you of an impending change to the product or these terms, an error in the price or description, a delay in delivery due to events beyond our control;  

  • because you have a legal right to do it as a result of something we have done wrong.

In all other circumstances (including if you exercise the​​ your right to change your mind) you have to pay the return costs. If you are responsible for the return costs and we are collecting the product from you, we will charge you the direct cost of the collection.

How we will refund you. We will refund the price you paid for the products including delivery costs, using the method you used for payment. However, we can make deductions from the price, as described below.

Deductions from refunds if you are exercising your right to change your mind.

If you are exercising your right to change your mind:

we may reduce the price refund (excluding delivery costs) if there has been a reduction in the value of the goods, due to deterioration of the product, if this has been caused by its incorrect handling, such that it is not allowed in a shop. If we refund the price you paid before we are able to inspect the goods and then find that you have handled them in an unacceptable manner, you must pay us an appropriate amount. The maximum refund for delivery costs will be the delivery costs with the least expensive delivery method we offer. For example, if we offer 3-5 day delivery of a product at a cost but you choose to have the product delivered within 24 hours at a higher cost, we will only refund you what you would have paid for the cheapest delivery option.

8. OUR RIGHTS TO RESOLVE THE CONTRACT

We can terminate the contract for a product at any time by writing to you if:

  • you do not make any payment to us when it is due and you do not yet make payment within 10 working days from the time we remind you that payment is due;

  • you do not provide us, within a reasonable time requested by us, with the information necessary to supply the products; or you do not allow us, within a reasonable time, to deliver the products to you or to collect them from us.

9. PRICE AND PAYMENT

Where to find the price of the product. The price of the product (which includes VAT) will be the price indicated on the order pages when you placed your order. We take all reasonable care to ensure that the recommended product price is correct. However, see clause 3 to find out what happens if we discover an error in the price of the ordered product.

When you have to pay and how you have to pay.

We accept payments with Visa, MasterCard, Amex, Maestro and PayPal. You have to pay for the products before we ship them. Payments are processed for us by wix.com and shipping is made for us by the Italian Post Office or UPS.

10. OUR RESPONSIBILITIES

Our products are created and packaged by GLG Cosmetici sas and the authorities can contact them for clarification on the product or view the product information file.

Any allergies are attributable to the individual subject not to the product.

A product becomes prosecutable when, for example, it contains components not declared on the label, so in case of fraud, but everything contained within our products is declared on the label, so it is up to the customer, who knows he is allergic. , make sure that there are no ingredients that are dangerous for him, before buying the product.   We will only use your personal information as set out in our privacy policy. We will only provide your personal information to third parties where the law requires us or allows us to do so.
